General Terms and Conditions of CPE Europe GmbH

I. Scope of these terms and conditions

The following General Terms and Conditions (GTC) govern the contractual relationship between CPE Europe GmbH, Albert-Einstein-Ring 11-15, D-22761 Hamburg, telephone: +49-40-209348500, email: info@edu.umch.de (hereinafter referred to as "CPE") and the applicant for a degree in human medicine at the "George Emil Palade University of Medicine, Pharmacy, Natural Sciences and Technology Neumarkt am Mieresch" (hereinafter referred to as "UMFST"), including University Medicine Neumarkt a. M. Campus Hamburg (hereinafter referred to as "UMCH" in the version valid at the time of booking.

Third parties cannot derive any claims from this contractual relationship.

The information contained in brochures, advertisements, and other promotional materials is non-binding unless the information contained therein has been expressly designated as binding by CPE, UMFST, or UMCH.

II. Conclusion of the service contract

By submitting the online registration to CPE, the applicant makes a binding offer to conclude a contract with the service commitments described in IV and V. The contract is concluded upon confirmation of the applicant's online registration (declaration of acceptance). The applicant waives receipt of the declaration of acceptance.

III. Online registration and payment

To register online, the applicant must log on to the homepage https://admission.edu.umch.de/mft and fill in the required information. Payment is processed by an external provider, to whose website the applicant is redirected. This is followed by an exchange between the applicant and CPE.

IV. Services provided by CPE

CPE provides the following services:

  • Comprehensive advice, especially when deciding on a degree program or preparatory studies (pre-medical/preparatory courses)
  • Comprehensive support in preparing the applicant's written application documents for a degree in human medicine at the "University of Medicine, Pharmacy, Natural Sciences and Technology Neumarkt am Mieresch (UMFST.)" or at the University Medicine Neumarkt a.M. Campus Hamburg (UMCH)
  • Checking the applicant's registration documents and completing the registration for the above-mentioned application process, including submitting the application
  • Organizing and administratively implementing the application process and the entrance examination.

CPE cannot guarantee the applicant a place at the university, as the final decision on admission is made by the UMFST.

CPE is not liable for any wasted expenses or other disadvantages incurred by the applicant as a result of the rejection.

Those who have completed the admission procedure will receive – depending on their success in the evaluation and interview of the admission procedure –

  • within the scope of available capacity, an offer for the upcoming winter semester or – if the capacity for study places for the upcoming winter semester is exhausted –
  • acceptance for the winter semester immediately following the upcoming winter semester with the offer to be placed on the waiting list for the upcoming winter semester, or
  • a rejection.

V. Remuneration for CPE services

  1. (For all of the services described in III provided by CPE in connection with the application process, the applicant shall pay a fee of €595, including the value-added tax applicable at the time the contract is concluded. This fee is due upon confirmation of the conclusion of the service contract by CPE. The remuneration is payable exclusively for the services provided by CPE and is independent of whether the application is successful and the applicant is offered a place at university.
  2. (Any costs that may be incurred for certifications, translations, or similar services are not covered by the fee specified in (1); if such costs are incurred, the applicant shall bear them themselves.

VI. Applicant's duty to cooperate and provide truthful information

  1. The applicant is obliged to cooperate insofar as this concerns information and documents from his sphere of influence as well as actions that are necessary or expedient for the preparation of the application and examination. The applicant must submit the information, documents, and actions required for the application and examination to CPE immediately upon request by CPE.
  2. The applicant is obliged to provide only truthful and complete information in their application. The university may verify the authenticity and accuracy of the documents and information provided by the applicant. If the university determines that the applicant has provided false or misleading information, it may inform the relevant institutions, organizations, or persons affected by this false or misleading information, in compliance with data protection regulations.

VII. Liability and force majeure

  1. CPE's liability is excluded in the event of simple negligence in the breach of non-essential contractual obligations and, in the event of negligence in other respects, is limited to the damage foreseeable at the time of conclusion of the contract and typical for the contract. Essential contractual obligations are those without the fulfillment of which the purpose of the contract is jeopardized and on the observance of which the student may rely.
  2. The limitations of liability do not apply to injury to life, limb, or health, or to liability for damages under the ProdHaftG (German Product Liability Act).
  3. In accordance with (1) and (2), CPE does not guarantee a place at university. CPE also accepts no liability for rejections due to documents not being provided by the applicant or being provided late.
  4. In accordance with (1) and (2), CPE accepts no liability for the recognition of the degree awarded by the university without further steps, such as additional examinations; the applicant is responsible for obtaining the relevant information and taking the necessary measures.
  5. In accordance with (1) and (2), CPE accepts no liability for admission to the program, in particular if political events occur or if, contrary to expectations, the country in which the university is located leaves the EU or no longer follows the Bologna Process.

IX. Applicable law

The service contract is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The legal provisions restricting the choice of law and the applicability of mandatory provisions, in particular those of the country in which the applicant has their habitual residence, remain unaffected.

X. Right of withdrawal

CANCELLATION POLICY

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date on which the declaration of acceptance was issued.

To exercise your right of withdrawal, you must inform us (info@edu.umch.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.
